Attention Industry Partners:
As a result of the passage of the Bipartisan Infrastructure Law (BIL) and the Infrastructure Investment and Jobs Act (IIJA) (Pub. Law 117-58, Nov. 15, 2021) there have been statutory changes to the Buy America Program. The Maryland Department of Transportation State Highway Administration (MDOT SHA) was required to make updates in accordance with the Build America, Buy America (BABA) Act.
Within the contract documents, these updates are found in the Buy America sections of the Proposal Form Packet (PFP) as well as the Invitation for Bids Section 875, Utilities Special Provision (where applicable). The updated Buy America provisions apply to projects partially or totally financed with Federal funds that advertise on or after November 15, 2022.
The Federal Highway Administration (FHWA) is providing regular interpretation and clarification on implementation of the new law. MDOT SHA will continue to update industry partners as the information becomes available.
