Monetary Obligations Owed to the State of West Virginia
Please be advised that beginning with the December 13, 2022, letting the form State of West Virginia, Department of Transportation, Division of Highways Affidavit (Monetary Obligations Owed to the State) will no longer be required.
Instead, all bidders will be required to confirm, pursuant to W. Va. Code � 5-22-1(i), that they are not in default on any monetary obligation owed to the State or a political subdivision of the State, at the time of bid. This confirmation will be in the electronic bid file under the section titled “Notice to Bidders” and in the proposal document under Supplemental Specification 102, Bidding Requirements and Conditions, dated July 5, 2022.

Requests to Perform Project Specific Special Provision Item(s)
Beginning with the letting of November 15, 2022, the process for Requests to Perform Project Specific Special Provision Item(s) and Provisional Categories of Work has been updated to remove the requirement to submit forms no later than five (5) calendar days before a letting. Please see the current Contractor Prequalification Application for additional information.

Important Information Regarding Disadvantaged Business Enterprise (DBE) Plans
Please be advised, beginning with the August 9, 2022, letting, any bidder who fails to submit their DBE plan within the required five (5) calendar day timeframe may forfeit their bid bond.
This is a requirement for all bidders, not just the apparent low bidder, on projects where a DBE goal is established and the Special Provision for Disadvantaged Business Enterprise Utilization, dated July 23, 2020, is included in the proposal documents.
Information on where to submit DBE plans is available in the Special Provision for Disadvantaged Business Enterprise Utilization, dated July 23, 2020.
